No one ever goes into the business of helping people thinking they will be sued. Her new client form only asked for contact information and what types of massage they prefer. What Joan didn’t know was that this client had torn his hamstring a month before the massage. The sports massage aggravated the injury, causing him to require more physical therapy.

Joan wasn’t responsible for the injury, and she didn’t show negligence in her duty of care for her client, so can the client sue? The answer is yes, and Joan still has to deal with the legal expenses to defend herself and her business. She doesn’t have a lawyer on retainer, nor does she have $25,000 to give.
